This makes no sense to me. He must have had the worse lawyer in the world. Information should never be illegal… sure the application of information is often a criminal act but information on making explosive devices is available from the US Government. How can it be a crime for a citizen to LINK to the same information?

Man Gets 1 Year for How-To on Explosives

20-year-old man was sentenced to one year in federal prison Monday for linking to sites offering recipes on how to make Molotov cocktails and other explosive devices on an anarchist Web site he operated.

I’m still confused about how this poor guy could get the shaft for posting information. If you want to see the REAL DEAL on making explosives… check this “TM 31-210 Department of the Army Technical Manual” Here is one site that you can read it on but you only have to put “TM 31-210” in a search engine like Google to find over 600 sites dealing with this information.

They get right to the nitty-gritty and even explain IN DETAIL how to make the explosives that Timothy McVeigh used to blow up the Federal building in Oklahoma City. Here is an excerpt:

FERTILIZER EXPLOSIVE

An explosive munition can be made from fertilizer grade ammunition nitrate and either fuel or a mixture of equal parts of motor oil and gasoline. When properly prepared, this explosive munition can be detonated with a blasting cap.

MATERIALS REQUIRED:

Ammonium nitrate (not less than 32% nitrogen) Fuel oil or gasoline and motor oil (1:1 ratio) Two flat boards. ( 2 x 4 and 36 x 36.) Bucket or other container for mixing ingredients Iron or steel pipe or bottle, tin can or heavy-walled cardboard tube Blasting cap, Wooden rod - 1/4 in. diameter Spoon or similar measuring container

PROCEDURE: …well you get the idea. NOTHING is left to your imagination. If you can make a Pizza you could follow this recipe… and the OTHER 25 HIGHLY EXPLOSIVE devices they describe.

…and this is ONLY ONE document the government has published on making explosives. Put “military handbook explosives” in any search engine and find at least 13,000 websites and pdf documents.

เขาน่าจะพิจารณาที่เจตนาด้วยมังคะ ไม่น่าแค่ดูจากเว็บเฉยๆ (หรือไง?)

Man jailed for linking to bomb sites

LOS ANGELES, California (AP) --A federal judge sentenced a man to a year in prison Monday for creating an anarchist Web site with links to sites on how to build bombs.

U.S. District Judge Stephen Wilson sentenced Sherman Austin to more than the prosecutor had recommended under a plea bargain.

Austin, 20, pleaded guilty in February to distributing information related to explosives.

Austin told the judge Monday he “wasn’t really thinking” when he created the Web site. “I’d be devastated if someone used this information to harm others,” he said.
Protest against police brutality?

Austin admitted posting links about bombs to enable people to build and use them during demonstrations against interstate and foreign trade. He told FBI agents he wanted the Web site to teach people about police brutality.

Austin must also pay a $2,000 fine and is barred for three years from using a computer without approval. Wilson said he also may not associate with anyone from a group that “espouses physical force as a means of change.”
Arrested during demonstration

Austin was arrested with other protesters at the World Economic Forum in New York in February 2002 on charges of disorderly conduct and unlawful assembly. While in New York, federal charges were handed down in California.

Austin said he took a plea bargain because he feared his case was eligible for a terrorism enhancement, which could have added 20 years to his sentence. The plea deal had called for him to serve four months.
